Welcome to Bravyn. These Terms of Service (“Terms”) are a legally binding agreement between you (“Client,” “you,” or “your”) and Bravyn, led and operated by Jaaziel Bournes. By accessing or using any of Bravyn’s services, you agree to be bound by these Terms.
Bravyn is a youth‑led, independent creative platform. It is not a registered company, corporation, or legal entity. All services are provided on a personal freelance basis. By engaging with Bravyn, you acknowledge and accept that you are entering into an agreement with an individual provider and that Bravyn operates with minimal liability.
2. Nature of Services
Bravyn offers creative and branding services, including but not limited to:

Social media and marketing asset creation
All services are delivered “as‑is” and “as available.” While Bravyn strives for high‑quality results, no guarantees are made regarding specific outcomes, performance, or results beyond what is explicitly agreed in writing.
3. Informal Status & No Corporate Protections

Bravyn is not a legally incorporated business.

All transactions are personal agreements between you and Jaaziel Bournes.

No corporate insurance, warranties, or statutory protections apply.

You agree that you are engaging with a youth‑led creative service and accept the inherent limitations.
4. Minimal Liability
To the maximum extent permitted by law:

Bravyn, Jaaziel Bournes, and any third‑party providers, collaborators, or affiliates involved in delivering our services are not liable for any indirect, incidental, consequential, or punitive damages.

Our total liability for any claim is limited to the amount you paid for the specific service in question.

Delays caused by you, third‑party platforms, or force majeure events.

5. Payment & Checkout

All payments must be made in full before work begins.

Payments are processed securely through various accepted methods, which may include Cash App and other agreed‑upon options.

You must include your full name in the payment note or order form to match your project request.

Orders are not confirmed until payment is received in full.

All sales are final unless otherwise agreed in writing.

Bravyn is not responsible for payment errors, failed transactions, or delays caused by third‑party payment processors or platforms.

You are solely responsible for ensuring you have the legal right to use the payment method provided. Unauthorized use of a payment method — including minors using a parent’s or guardian’s card without permission — is the responsibility of the payment method owner, not Bravyn.

Any disputes regarding unauthorized use must be resolved directly between the payment method owner and their financial institution.
6. Right to Refuse Service
Bravyn reserves the right to:

Refuse service to anyone, for any reason, at any time.

Cancel an order before work begins, with a refund if payment has been made.

Decline projects that:

Promote hate speech, violence, or illegal activity.

Conflict with Bravyn’s values or brand image.

Are deemed inappropriate or unethical.

7. Right to Post Work
By ordering from Bravyn, you grant us the right to:

Display completed work in our portfolio, on social media, or in marketing materials.

Use project visuals for promotional purposes unless you request in writing, before work begins, that your project remain private.
8. Client Responsibilities
You agree to:

Provide accurate, complete, and timely information for your project.

Respond to communications promptly.

Ensure you have the legal rights to any materials you provide (e.g., images, text, logos).

Approve or request revisions within the agreed timeframe.
9. Turnaround & Revisions

Estimated delivery times are provided as a courtesy and are not guaranteed.

Revisions are limited to what is stated in your service description.

Additional revisions or changes outside the original scope may incur extra charges.
10. Intellectual Property

Upon full payment, you receive the rights to use the final deliverables for your intended purpose.

Bravyn retains the right to showcase the work unless otherwise agreed.

Source files may be provided at our discretion or for an additional fee.

You may not resell or redistribute Bravyn’s work without written permission.
11. No Guarantees
Bravyn does not guarantee:

Specific sales, engagement, or business outcomes.

Compatibility with all platforms, devices, or formats.

That our services will meet every expectation without clear, written agreement.
12. Third‑Party Services
Bravyn may use third‑party tools or platforms to deliver services. We are not responsible for:

Loss of access to third‑party accounts.

Changes in third‑party pricing or terms.
13. Age & Legal Capacity
By using our services, you confirm that:

We are not responsible for verifying parental or guardian consent or for unauthorized use of payment methods by minors.
14. Dispute Resolution

You agree to waive the right to participate in class actions against Bravyn.
15. Indemnification
You agree to indemnify and hold harmless Bravyn and Jaaziel Bournes from any claims, damages, or expenses arising from:
